1. Purpose The purpose of these Terms of Use is to define the rights, obligations, and responsibilities of the Company and the User in connection with the use of the website (https://littleone.io) and related services (the "Services") provided by Littleone Inc. (the "Company").

3. Effectiveness and Modification of the Terms of Use

  1. These Terms of Use become effective when the User accesses the website and completes the consent process.
  2. The Company may modify these Terms of Use to the extent permitted by applicable laws. The Company will provide notice of such modifications (e.g., via website posting or email) at least [15] days prior to the effective date (or at least [30] days prior for material changes potentially detrimental to the User), stating the changes, the effective date, and the reason for the modification. In urgent cases due to legal requirements, notice may be given after the fact.
  3. If the User does not agree to the modified Terms of Use, the User may stop using the Services and request to withdraw from membership. If the Company clearly notifies the User when announcing the modified terms that failure to explicitly object within a specified period will be deemed as consent, and the User does not explicitly object and continues to use the Services after the effective date of the modified Terms of Use, the User shall be deemed to have agreed to the modified Terms of Use. However, for material changes significantly impacting User rights, the Company may require explicit consent.

4. Membership Registration and Withdrawal

  1. A person who wishes to use the Services may apply for membership in accordance with the procedures set by the Company, and may register as a member upon the Company's approval.
  2. The Company may not approve or may terminate the user agreement thereafter in any of the following cases:
    • If the application contains false information, omissions, or errors.
    • If a child under the age of 13 applies for membership without verifiable parental consent (as required by COPPA). The Company may require procedures to verify parental consent.
    • If the application uses another member's ID or personal information.
    • If it is reasonably determined that the application may significantly interfere with the Company's operation of the Services.
    • If the application violates these Terms of Use or applicable laws, or is otherwise found to be unlawful or improper.
  3. A member may request withdrawal from membership at any time, and the Company shall promptly process such request in accordance with relevant laws and the Privacy Policy. Upon withdrawal, all of the member's information shall be promptly deleted, except for information that is required to be retained for a period specified by relevant laws or the Company's Privacy Policy.

5. User's Obligations

  1. The User shall comply with these Terms of Use, any matters notified by the Company, and applicable laws, and shall not engage in any activities that interfere with the Company's business.
  2. The User is responsible for managing their ID and password and shall not transfer, lend, or allow a third party to use them. The User is solely responsible for any consequences resulting from the User's negligence or unauthorized use.
  3. The User shall use the smart devices provided by the Company correctly and shall comply with the user manual and safety instructions. The User is solely responsible for any consequences resulting from the User's improper use.
  4. The User shall not engage in any of the following activities:
    • Impersonating another person or using their personal information without authorization.
    • Infringing on the Company's intellectual property rights, such as copyrights and trademarks.
    • Interfering with the normal operation of the website or causing an excessive load on the server.
    • Posting or transmitting illegal information, obscene materials, spam messages, or other content contrary to public order and morals.
    • Disassembling, modifying, reverse-engineering, or repairing the Company's smart devices without authorization, or using them in an abnormal manner.
    • Any other activity that violates relevant laws or is deemed socially unacceptable.

6. Company's Obligations

  1. The Company shall not engage in activities prohibited by law and these Terms of Use or contrary to public morals, and shall strive to provide continuous and stable Services.
  2. The Company shall implement security systems to protect personal information (including credit information) so that Users can use the Services safely, and shall publish and comply with its Privacy Policy. Users can review the full Privacy Policy on the Company's website at any time.
  3. The Company shall strive to handle legitimate opinions or complaints raised by the User in connection with the use of the Services and address any resulting damages. If prompt handling is difficult, the Company will notify the User of the reason and the processing schedule.
  4. The Company warrants the quality and performance of the smart devices it provides in accordance with relevant laws and regulations, and shall repair, exchange, or refund any defects that occur within the warranty period according to applicable laws and consumer dispute resolution standards.

7. Provision and Modification of Services

  1. The Company provides the following Services through the website:
    • Product information and sales
    • Member community features (may be provided in the future)
    • Customer support and inquiries
    • Applications and software related to smart devices
    • Other services determined by the Company
  2. The Company may modify the content, usage methods, and usage hours of the Services, and shall provide notice of such modifications in accordance with Section 3.2.

8. Copyright and Intellectual Property Rights

  1. All intellectual property rights, including copyrights, patent rights, trademark rights, and design rights related to the website and the Services, belong to the Company.
  2. The User shall not, without the Company's prior written consent, use the contents or Services of the website for commercial purposes in any manner, such as reproduction, distribution, transmission, modification, rental, or the creation of security interests.
  3. The intellectual property rights to the applications and software related to the smart devices provided by the Company belong to the Company or its licensors, and the User is granted a non-exclusive license to use them only within the scope permitted.

9. Limitation of Liability

  1. The Company shall be exempt from responsibility for providing the Services if it is unable to do so due to force majeure events such as natural disasters, war, interruption of telecommunications services, facility maintenance, replacement or failure, or system failures.
  2. The Company does not guarantee the reliability, accuracy, or content of information, data, or facts posted or transmitted by the User on the website, and shall not be liable for any damages arising therefrom.
  3. The Company shall not be liable for any damages resulting from the User's improper use of the Company's smart devices or failure to comply with the user manual and safety instructions. This does not exempt the Company from liability under applicable product liability laws.
  4. The Company shall not be liable for any disruption or damages to the User's use of the Services due to reasons attributable to the User.
  5. However, these limitations of liability shall not apply to damages resulting from the Company's willful misconduct or gross negligence, death or personal injury caused by the Company, or in other cases where liability cannot be excluded or limited under mandatory applicable law.

10. Dispute Resolution

  1. In the event of a dispute between the Company and the User in connection with the use of the Services, the parties shall negotiate in good faith to resolve the dispute amicably.
  2. These Terms of Use and any dispute arising out of or related to the Services shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of laws principles.
  3. Matters not specified in these Terms of Use or disagreements in the interpretation of these Terms of Use shall be governed by relevant laws and customary practices.
  4. If the dispute is not resolved through negotiation under paragraph 1, any legal action shall, in principle, be brought exclusively in the court having jurisdiction over the location of the Company's headquarters in Korea. However, if you are a consumer residing outside of Korea, mandatory provisions of the law of your country of residence may apply, potentially granting you the right to bring proceedings in your country of residence.

Addendum These Terms of Use shall be effective as of April 19, 2025.
